Rules and Regulations (the "Rules")
NO PURCHASE IS NECESSARY TO ENTER THIS CONTEST.
The Contest is open to all residents of Canada who have reached the age of majority in the province in which they reside, except the directors, officers, agents and employees of Reitmans (Canada) Limited (the owner of the Penningtons, Addition Elle and 1-PLUS divisions) and all of its affiliated and associated entities and divisions ("Reitmans"), its advertising and promotional agencies, and members of their respective immediate families living in the same household.
By entering this Contest, each entrant accepts the terms and conditions of these rules and regulations and agrees to be bound by them. This Contest is subject to all applicable federal, provincial and local laws and regulations. This Contest is void where prohibited by law.
GRAND PRIZE: One (1) Grand Prize ("Grand Prize") is available to be won, which shall consist of a one-time, lump sum payment of two thousand five hundred Canadian dollars (CDN$2,500.00) and a wardrobe shopping spree from either Addition Elle or Penningtons (at the winner’s discretion) valued at two thousand five hundred Canadian dollars (CDN$2,500.00). The Grand Prize has a total retail value of five thousand Canadian dollars (CDN$5,000.00). Reitmans reserves the right, in the event that the Grand Prize or any element of the Grand Prize cannot be awarded as described for any reason, to substitute another prize or component of a prize of equal or greater value, without liability.
The Grand Prize must be claimed towards the actual inventory of any participating Addition Elle or Penningtons store. The Grand Prize must be accepted as awarded without substitution and is not transferable, not for resale and has no surrender value. No prize substitution is allowed for all or any portion of the Grand Prize awarded hereunder except at the discretion of Reitmans. The Grand Prize cannot be combined with any other offer and must be accepted as is. No refund, rain checks or compensation of any costs or expenses incurred by the Contest winner shall be made. Addition Elle and Penningtons club membership discounts and point accumulation cannot be applied towards the redemption of the Grand Prize. Any products purchased using the Grand Prize cannot be returned after pick-up. Choices of colours and sizes are subject to availability in that specific Addition Elle or Penningtons store.
The Contest begins on at 12:00:01 AM (Eastern time) on November 4, 2009 and ends at 11:59:59 PM (Eastern time) on December, 13 2009 (“Entry Deadline”). All entries must be received by the Entry Deadline.
To enter for a chance to win the Grand Prize simply go online at either of www.penningtons.com, www.mxm.ca, or www.additionelle.com (the “Websites”) and follow the instructions to file an on-line ballot. There is a limit of one (1) entry per person (i.e. per e-mail address). All additional entries will be disqualified. Entries generated by a script, macro or other automated means are void. Entries that contain typographical errors, are altered, tampered with, incomplete, inaccurate, irregular in any way, or otherwise not in compliance with these Rules, are also disqualified. Odds of winning the Grand Prize will vary depending on the number of eligible Contest entries received. All entries become the property of Reitmans.
For purposes of awarding the Grand Prize, a random draw will be held at the head offices of Reitmans in Montreal, Quebec on December 16, 2009 at 3:00 p.m. Eastern time (“Draw Date”), in order to select the Grand Prize winner among all of the eligible entries received by the Entry Deadline.
Only the selected winner will be contacted by email, mail or telephone within seven (7) business days of the Draw Date. If the selected winner cannot be reached within seven (7) business days of the Draw Date, the selected winner will be disqualified and another winner will be selected by a random drawing conducted by Reitmans until such time as contact is made by email, mail or telephone with a selected winner. Reitmans will not be responsible for failed attempts to contact a selected winner. If a Grand Prize cannot be awarded due to actions or circumstances beyond the control of Reitmans, a substitute prize of equal or greater retail value may be awarded. The name of the Grand Prize winner shall appear on the Websites as well as Reitmans’ online social networking and media marketing pages for no less than thirty (30) days following selection and confirmation of said winner.
Reitmans reserves the right to verify eligibility qualifications of the Contest winner. The Contest winner must comply with these Rules and correctly answer a time-limited, mathematical skill-testing question (without the assistance of another person or mechanical device) to be administered by a representative of Reitmans. In addition to the foregoing and in order to be eligible to receive the Grand Prize awarded hereunder, the selected winner must execute a full release and affidavit of eligibility in a form to be provided by Reitmans which relieves Reitmans from any and all liability for injury associated with any prize awarded to him/her, as well as satisfy any and all laws and regulations and other criteria required by the selected winner’s province of residence. Once the selected winner has satisfied these requirements, he/she will be entitled to claim the Grand Prize at a participating Addition Elle or Penningtons store nearest to the winner or otherwise in accordance with instructions given by Reitmans.
By entering this Contest, all entrants irrevocably grant to Reitmans the right to include their name and information on any of Reitmans’ mailing lists for promotional purposes relating to Reitmans, and to use their name in any publicity carried out by Reitmans, and grant to Reitmans a non-exclusive irrevocable license and right to incorporate, use and reproduce their photograph, voice, name, likeness and city and province of residence in whole or in part in and in connection with the advertising, exhibiting, marketing, promotion and exploitation of its business in any manner, in all media throughout the world. Those individuals who do not wish that their personal information be used for such purposes are required to so indicate in writing to Reitmans at the following address: 250 Sauvé Street West, Montreal, Quebec H3L 1Z2; ATTENTION 1-PLUS Customer Service. All personal information collected by Reitmans shall be used in accordance with the Privacy Policy located at www.1-plus.com.
In no event shall Reitmans be held liable for any delays or cancellations in awarding the Grand Prize due to circumstances beyond its reasonable control. Contest entrants assume all liability for injuries caused or claimed to be caused by participation in this Contest, or the use or misuse of any prize granted herein, including any all and losses, damages, claims, actions and causes of action with respect to any prize so granted. Without limiting the generality of the foregoing, by entering this Contest, entrants release and forever discharge Reitmans and its parent company, affiliates, subsidiaries, agents, and advisors and the employees, officers, directors, shareholders, agents and representatives, from any and all damages, rights, claims, costs and actions of any kind whatsoever arising in connection with the Contest or resulting from acceptance, possession, or use or misuse of the Grand Prize, or any other prize awarded in connection with the Contest, including without limitation personal injury, death, and/or property damage as well as claims based on publicity rights, defamation, or invasion of privacy.
Reitmans and its respective affiliated and associated entities, assume no responsibility for lost, stolen, mutilated, late, misdirected or ineligible entry forms or for any computer, online, human or technical malfunctions that may occur in the administration of the Contest. Subject to a contrary stipulation by the Régie (as hereinafter defined), if for any reason this Contest is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other cause beyond the control of Reitmans, or its respective affiliated and associated entities, or any act corrupts or affects the administration, security, fairness, integrity or proper conduct of this Contest, Reitmans reserves the right, in its absolute and sole discretion, to disqualify an individual and/or cancel, terminate, modify or suspend the Contest. Reitmans and its affiliated and associated entities, shall not be responsible under any condition whatsoever for any problems or technical malfunctions relating to the Contest or for any printing or typographical errors or problems in connection with any Contest-related materials. Any attempt by anyone to damage or disrupt the Contest shall be considered a violation under criminal and civil law. Reitmans and its respective affiliated and associated entities, reserve the right to seek damages or other remedies against such person to the fullest extent permitted by law, including criminal prosecution.
In the event of any dispute regarding entries received from multiple users having the same e-mail account, entries will be deemed to be made by the authorized account holder of the e-mail address submitted during entry. The “authorized account holder” is the natural person who is assigned to the e-mail address by an internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. The winning entry may be required to provide Reitmans with proof that the claimed winner is the authorized account holder of the e-mail address associated with the winning entry, or forfeit a prize.
It is the entrant’s sole responsibility to notify Reitmans in writing at the address indicated above if he/she changes his/her address, e-mail address or telephone number. All corrections must be received prior to the Entry Deadline.
- If any terms of these Rules are or become invalid, are ruled illegal by any court of competent jurisdiction or are deemed unenforceable under then current applicable law, it is the intention of the parties hereto that the remainder of these Rules shall not be affected thereby and shall remain in full force and effect.
Any litigation respecting the conduct or organization of a publicity Contest may be submitted to the Régie des alcools, des courses et des jeux (“Régie”) for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
